BORP Waiver, Release of Liability, and Media Release Agreement

Notice: This is a legally binding agreement. Please read carefully.

1. Risks of Activity: Participation involves inherent risks of physical injury or death. The undersigned assumes all risks associated with the activities, including the condition of the equipment and premises, as well as the acts and omissions of the Released Parties.

2. Risks of Participation: The undersigned acknowledges and assumes all risks of communicable diseases, including COVID-19, related to participation in BORP activities.

3. Release and Indemnification:

• Release: The undersigned releases BORP from all liability for any harm, wrongful death, personal injury, or property damage arising from participation in BORP activities, including negligence of the Released Parties.
• Indemnification: The undersigned agrees to indemnify and hold harmless BORP from any claims, suits, or demands, including legal fees, arising out of participation in BORP activities.

4. Medical Treatment:

• The undersigned agrees that BORP has permission to administer first aid and authorize emergency medical treatment if necessary and that BORP is not liable for any injury or damage arising from such medical treatment.

5. Miscellaneous:

• The undersigned agrees not to engage in prohibited activities.
• This agreement is governed by California law, with exclusive jurisdiction in Alameda County.
• Binding upon heirs, next of kin, executors, and personal representatives.
• The agreement is to be construed broadly to provide a release and waiver to the maximum extent permissible under applicable law.
• If any part of this agreement is held invalid, the remainder will continue in full force and effect.

6. Media Release:

• The undersigned grants BORP the right to use, for promotional purposes, any photographs, digital recordings, and/or videos taken during any BORP or BORP-relevant event in which the undersigned appears. Such images may be used in BORP brochures, posters, website, or other promotional materials without liability or payment.

Acknowledgment:

• By agreeing to this waiver, the undersigned confirms understanding and agreement to the terms.
• The undersigned represents that they are at least 18 years of age and legally permitted to sign this agreement on their own behalf or are the parent/guardian of the participant.
